Who we are and what these terms cover
Course AI Builder (the “service”) is provided by Individual Entrepreneur Axel Elearning, University st. 17a, floor 10, Vake, Tbilisi, Georgia, tax identification number 305797741 (“we”, “us”, “our”). These Terms of Service (the “Terms”) govern your access to and use of the service, including the application at https://app.courseaibuilder.com and this website.
By creating an account or using the service you agree to these Terms, to the Acceptable Use Policy and, if you use the service for a business, to the Data Processing Terms. Our Privacy Policy explains how we handle personal data. If you use the service on behalf of an organisation, you confirm that you may bind it to these Terms, and “you” includes that organisation.
Merchant of Record
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries about orders and payments and handles returns.
When you buy a course pack, your purchase is made from Paddle.com Market Limited (“Paddle”) as reseller, and Paddle’s Buyer Terms apply to the purchase. Paddle takes the payment, calculates and collects sales tax or VAT, issues invoices and receipts, and handles refunds and chargebacks. Questions about a charge can go to Paddle or to us.
These Terms govern your use of the service. Where these Terms and Paddle’s Buyer Terms differ about the purchase itself, the Buyer Terms apply to the purchase.
We receive from Paddle only what we need to give you access: the pack you bought, the order status, and customer and transaction identifiers. We never receive your full payment card details.
The service
The service uses artificial intelligence to draft course outlines, lesson pages with interactive elements and graded quizzes from topics and documents you provide. You approve the outline, review and edit the drafts, and export them as SCORM 1.2 packages and, after any purchase, as a full course backup file, to use in your own learning management system. We do not host courses for learners.
The service is in early access. Features are added, changed and sometimes removed. If we remove or materially reduce a feature that a purchase includes, we will tell you at least 30 days in advance where we reasonably can.
Accounts
You must be at least 18 years old and able to enter into a contract. Give correct information when you sign up and keep it up to date. Each login is for one person; keep your password secure and tell us at support@courseaibuilder.com if you think someone else has used your account. You are responsible for what happens under your account.
Course packs and the free trial
Pay per course. The service is sold per course, in one-off packs. Packs, prices and what a purchase includes are shown on the pricing page:
| Pack | Price (USD) | Price per course |
|---|---|---|
| 1 course | $199 | $199 |
| 5 courses | $799 | $159.80 |
| 10 courses | $1,399 | $139.90 |
Prices are shown in USD. Paddle may show the price in your local currency and adds VAT or sales tax where it applies before you pay. Businesses in the European Union can enter a VAT number at checkout, and the reverse charge applies where the law provides for it. For larger orders, payment by bank transfer against an invoice is available on request at support@courseaibuilder.com.
No subscription. Each pack is a single payment. Nothing renews and no further payment is taken unless you buy another pack.
What one course is. One course is one course you generate: its outline, lessons and a graded quiz for up to 10 modules, up to 20 page rewrites with AI, and editing, previews and exports as often as you need. A course from your balance is used when you start generating it. A course that cannot be produced because of a fault on our side is returned to your balance.
Purchased courses never expire. Unused courses stay in your balance while your account is open. They are personal to your account, have no cash value and cannot be sold or transferred. They are removed when you close your account; ask for a refund of unused courses first if you are still within the refund period.
What a purchase unlocks. Any purchase unlocks permanently for your account: exports and previews without a watermark, all lesson themes, up to 10 modules per course, SCORM 1.2 export per module or for the whole course, the full course backup file and the brand kit.
Free trial. The free trial is one course of up to 3 modules, in one lesson theme, with SCORM 1.2 export only. Its exports and previews carry the watermark “Made with Course AI Builder”. The trial is available once per person, needs no payment details and converts into nothing: no payment is ever taken unless you buy a pack. We may refuse or close accounts created to obtain repeated trials, accounts with disposable email addresses, and accounts created by automated means.
Price changes. We may change the prices of packs for future purchases. A price change never affects packs you have already bought.
Refunds. Refunds follow our Refund Policy, which includes a 14-day money-back guarantee on packs and courses you have not used, and are issued by Paddle.
Your content
“Inputs” are the topics, instructions and documents you provide. “Outputs” are the outlines, lessons, quizzes, images and packages the service generates for you. Together they are your “Customer Content”.
Ownership. As between you and us, you own your Customer Content, as far as the law allows. We claim no ownership of your Inputs or Outputs. Outputs are produced by third-party AI model providers, and your rights in them are subject to those providers’ terms. We pass on to you whatever rights in Outputs we receive under those terms. Some jurisdictions give limited or no copyright protection to purely machine-generated material; your own edits, selection and arrangement can strengthen your rights.
Your rights to your Inputs. You warrant that you own, or have all the rights, licences and permissions needed for, the Inputs you upload or enter, including copyright in documents and a lawful basis for any personal data they contain, and that using them with the service does not infringe anyone’s rights. You are responsible for your Customer Content and for how you use it.
Licence to us. You give us a worldwide, non-exclusive, royalty-free licence to host, copy, process, transmit and display your Customer Content only as needed to provide, secure and support the service for you, including sending it to the processors listed on the subprocessors page. The licence ends when the content is deleted, except for copies kept in backups for the periods stated in the Privacy Policy or kept where the law requires.
Similar outputs. AI models can produce similar outputs for different customers. Your rights in your Outputs do not extend to outputs generated for others.
Bundled components. Packages include fonts licensed under the SIL Open Font License and icons licensed under CC BY-SA 4.0. The licence texts are included in each package; keep them with the package when you distribute it. These licences cover the fonts and icons only, not your text.
Preview links. Anyone who has a preview link you create can view that course until the link expires or you turn it off. Share links only with people who may see the content.
Retention of files. Uploaded documents are deleted 30 days after upload, and exported packages and course backup files 30 days after they were created. Your courses stay in your account, and you can export them again at any time.
Feedback. If you send us suggestions, we may use them without obligation to you.
AI-generated content
Third-party models. Outputs are generated by AI models from third-party providers, listed on the subprocessors page. The providers’ usage policies apply to the content you submit, and our Acceptable Use Policy reflects them.
Outputs may contain errors. Outputs can be incorrect, incomplete, out of date, biased or unsuitable, and can include invented facts, sources or quotations. They are not professional advice of any kind. Quiz answer keys can be wrong.
You must review before use. You must review and, where needed, correct every Output before using it or making it available to learners. You are responsible for the courses you publish, for their suitability for your learners and for their compliance with the rules that apply to you.
AI marking. Packages state in their metadata, and in a notice visible to learners, that the content was generated with AI. Do not remove or alter that marking in a way that misleads learners or breaches transparency obligations that apply to you.
No training on your content. We do not use your Customer Content to train AI models. We use providers under their API terms, which do not allow using API data to train models by default. Some providers keep inputs and outputs for a limited period to detect abuse, as described in the Privacy Policy.
Assessment. Quizzes in the packages are scored by fixed rules against the answer key in your course. The service does not grade or assess learners with AI, and you must not present generated content as the judgement of a human assessor.
Acceptable use
You must follow the Acceptable Use Policy. In particular, you must not use the service to:
- generate or upload illegal content, or content that infringes the rights of others;
- generate content that depicts, imitates or makes claims about the likeness, voice or identity of a real person;
- create images of people or human faces. The service does not generate images of people, and you must not try to make it do so;
- harass, deceive or harm anyone, or attack or overload the service.
We may remove content, limit use, or suspend an account that breaches these rules, as described below.
Availability and support
We work to keep the service available but provide no service level agreement. The service may be interrupted for maintenance, by failures, or when an AI provider is unavailable. To protect the service we may limit usage, for example the number of generations running at the same time, and ask you to try again later.
Support is provided by email at support@courseaibuilder.com. We aim to reply within two business days; this is a target, not a commitment.
Keep your own copies of the packages you export. The service is not a backup or archive service.
Early access and warranties
The service is early-stage software provided “as is” and “as available”. To the extent the law allows, we make no warranties, express or implied, including of merchantability, fitness for a particular purpose, non-infringement, or that the service or its Outputs will be error-free or uninterrupted.
If you are a consumer, you keep the rights that consumer law gives you, and nothing in these Terms limits them.
Liability
To the extent the law allows, we are not liable for indirect or consequential loss, loss of profits, revenue, goodwill or data, or for losses arising from Customer Content you publish or from your reliance on Outputs you did not review.
To the extent the law allows, our total liability arising out of or in connection with the service is limited to the greater of the amounts you paid for the service in the 12 months before the event giving rise to the claim, and 100 USD.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, including liability for death or personal injury caused by negligence, for fraud, or for gross negligence or wilful misconduct where the applicable law does not allow it to be limited.
Indemnity
If you use the service for a business, you will defend and indemnify us against third-party claims arising from your Customer Content, from a breach of your warranty about your Inputs, or from your breach of the Acceptable Use Policy, including reasonable legal costs. This section does not apply to consumers.
Suspension, termination and deletion
By you. You can close your account at any time from your account page or by writing to support@courseaibuilder.com. Export anything you want to keep first. Unused courses are removed when the account is closed.
By us. We may suspend or close your account if you materially breach these Terms or the Acceptable Use Policy, if the law requires it, or if your use puts the service, other customers or third parties at risk. We will give notice and a chance to fix the problem where that is reasonable and lawful. If we close your account without cause, we will refund the courses you have not used.
If we stop the service. If we decide to stop offering the service, we will tell you at least 30 days in advance so that you can export your courses, and we will refund the courses you have not used.
Deletion. When an account is closed, its courses, uploaded documents, exports, brand kit and remaining courses are deleted from the service, normally within an hour, and remaining copies are removed from our backups within 30 days. Billing records are kept for as long as tax and accounting law requires. Sections that by their nature should continue, including ownership, liability and governing law, survive the end of the agreement.
Governing law and disputes
These Terms are governed by the laws of Georgia, and disputes are subject to the jurisdiction of the courts of Tbilisi, Georgia.
If you are a consumer living in the European Union, the European Economic Area, the United Kingdom or another country whose law gives you mandatory protection, you keep that protection, and you may also bring proceedings in the courts of the country where you live.
Before starting proceedings, please write to support@courseaibuilder.com so that we can try to resolve the matter.
Changes to these terms
We may update these Terms. For material changes we will tell you by email or in the application at least 30 days before they take effect. If you do not agree, you can close your account before then and ask for a refund of unused courses bought in the previous 14 days; continuing to use the service after the date means you accept the updated Terms. Changes never apply to purchases already made in a way that reduces what you bought. The date at the top of this page shows when they last changed.
General
These Terms, together with the policies they refer to, are the whole agreement between you and us about the service. If a provision is found unenforceable, the rest remains in force. Not enforcing a right is not a waiver of it. We may transfer this agreement to a successor of our business, and will tell you if we do. You may not transfer it without our consent. These Terms are written in English, and the English version applies.
